PURPOSE OF THIS DOCUMENT
1.1 These General Conditions of Sale (hereinafter “General Conditions”) govern the sale to final consumers (hereinafter “Customers” or “Customer”) of the products of Azienda Agricola Cancila di Macaluso Maria Anna (hereinafter “Products”) marketed through the e-commerce site: www.oliocancila.it (hereinafter the “Site”) following the procedures contained therein.

1.2 The sales of Products between Azienda Agricola Cancila di Macaluso Maria Anna and the Customers will be governed by these General Conditions.

1.3 The Products will be marketed through the site only in Italy.

1.4 For the purposes of these General Conditions, “final consumer” means any natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.

1.5 The Products are marketed by the Individual Company Azienda Agricola Cancila di Macaluso Maria Anna (hereinafter “Azienda Agricola Cancila”), VAT number 06784610823, with registered office in Via Mustafà, 51 90013 Castelbuono (PA).

1.6 Any information concerning these General Conditions and / or purchases made on the basis of the same can be requested through the contact form on the Website www.oliocancila.it/contatti.

METHOD OF CONCLUSION OF THE CONTRACT
2.1 The information and details contained on the e-commerce site should not be considered offers: they simply constitute an invitation to customers to conclude business by forwarding purchase proposals.

2.2 After the Customers have selected one or more products and added them to the cart, they will be able to view the summary of the selected products with the relative price, they will be able to update the selection, select the payment method and calculate the shipping costs (which also vary in in relation to the chosen payment method). After this, if the Customers intend to proceed with the purchase, they must click on “proceed to order” and a page opens containing the “order form” to be filled in which requires the following data: billing details, any indication of a place of delivery of the products other than that indicated for billing, confirmation of the payment method. The proposal to purchase the Products is formulated by the Customers at the time of sending the order form in electronic format by clicking on the “buy now” button.

2.3 Once the order form has been definitively sent, an email confirming receipt of the order is sent, together with the summary of the order and the instructions for payment (if bank transfer has been chosen as the payment method).

2.4 By sending the order form, the Customer accepts that any purchase contract will be governed by these General Conditions.

2.5 Therefore, all orders are subject to acceptance by Azienda Agricola Cancila, which reserves, at its sole discretion, the right not to proceed with any order proposal in the event that:
– the data provided by the Customer when completing the order form are incomplete or incorrect;
– the Customer does not qualify as a final consumer or does not meet the requirements to implement the payment conditions;
– the ordered Products are not available. To this end, Azienda Agricola Cancila will not be held responsible for changes in the availability of some Products. If only part of the ordered Products are not available and there are no other causes that may legitimize the non-acceptance of the order proposal, Azienda Agricola Cancila will follow up on the order proposal limited to the Products available.

2.6 In the cases indicated above, Azienda Agricola Cancila will inform the Customer by e-mail that the order proposal has not been accepted (in whole or in part) and, therefore, the contract is not concluded. In this case, Azienda Agricola Cancila will reimburse the Customer for any sums already paid by the latter.

2.7 The purchase contract between the Customer and Azienda Agricola Cancila will be concluded only when the Client’s order is accepted by Azienda Agricola Cancila which will take place with a specific email (different from and subsequent to the – automatic – confirmation of receipt of the order referred to in point 2.3.) in which the expected times for the delivery of the products will also be indicated.

PRICES AND TERMS OF PAYMENT
3.1 The selling prices of the Products, the shipping costs and the payment methods are those shown on the Site and are expressed in Euros. The selling prices of the Products include VAT but do not include shipping costs, which will be added to the total amount due. Azienda Agricola Cancila reserves the right to change the prices shown on the Site at any time. Under no circumstances can Azienda Agricola Cancila be held responsible for any price changes.

3.2 The Customer undertakes to pay the price of the Products purchased in the following ways:

– Paypal: in this case the charge will take place upon confirmation of receipt of the order (see 2.3.). In the event that Azienda Agricola Cancila does not accept the order proposal, the amount will be re-credited to the Customer.
– Bank transfer: payment must be made no later than 5 working days from sending the order, after which the order will be canceled. The bank details on which to make the payment are: Banca intesa San Paolo – Cc in the name of Macaluso Maria Anna – IT61X0306943220100000003343
It should be noted that the order number, the date of the order and the name of the purchaser (indicated in the billing data) must necessarily be indicated in the reason for payment.

– Cash on delivery: payment will be made in cash upon delivery directly to the courier.
Maximum order allowed 499 €.

METHOD OF SHIPPING OF PRODUCTS
4.1 The Products will be delivered within a maximum of 10 days from the acceptance of the order by Azienda Agricola Cancila: the shipping times will be indicated in the email referred to in point 2.7 of acceptance of the order and communication of the shipment. Transport costs for home delivery are charged to the customer. In the event of shipping delays arising from causes beyond the control of Azienda Agricola Cancila, the Customer will be promptly notified by the customer service of Azienda Agricola Cancila by email to the address indicated in the order confirmation form. Shipments are made only on the Italian territory.

4.2 The risks relating to the Products pass to the Customer upon delivery of the Products to the Customer or to a third party designated by him.

RIGHT OF WITHDRAWAL
5.1 The Customer has the right to withdraw without any penalty and without specifying the reason, within the term of 14 calendar days starting from the day of receipt of the Products purchased on the basis of these General Conditions.

5.2 The withdrawal may be exercised, within the term referred to in Article 5.1 above, by sending to Azienda Agricola Cancila an express declaration from the Customer containing his will to withdraw and return all or part of the purchased goods. The declaration of withdrawal can be sent by registered letter with return receipt. to the address of the registered office of the Individual Company or by pec to the e-mail address cancilavincenzo@pec.it. The declaration of withdrawal must contain the name, surname and address of the applicant, the exact identification of the products for which the return is requested with reference to the order number even in the case of partial return and the indication of the date of delivery. The appropriate form attached to these general terms and conditions may also be used.

5.3 It is an essential condition for the exercise of the withdrawal by the Customer that the integrity of the Products to be returned is preserved. In particular, the Products must not have been used, opened or damaged; the labels must still be attached to the Products.

5.4 The Customer must exercise the right of withdrawal within 14 calendar days from the date of receipt of the Products and must return the product / s at his own expense no later than 14 days from when he communicated to Azienda Agricola Cancila the will to withdraw.
The product must be returned at the expense of the Customer to the registered office of Azienda Agricola Cancila in Via Via Contrada Fiumara snc 90013 – Castelbuono (PA).

5.5 Azienda Agricola Cancila will notify the Customer by e-mail that it has received the declaration of withdrawal.

REFUND TIMES AND METHODS OF RETURNED PRODUCTS
6.1 Azienda Agricola Cancila will refund the purchase net of any discounts and / or promotions: in the event of a total return, the full price paid will be refunded, in addition to the shipping costs, while in the event of a partial return, only the cost of the return will be refunded. returned product (s) in addition to shipping costs.

6.2 The reimbursement of the aforementioned amounts will take place as soon as possible and in any case within 14 days (fourteen) days from the date on which Azienda Agricola Cancila became aware of the Customer’s exercise of the right of withdrawal.

6.3 The refund will be made by Azienda Agricola Cancila according to the payment method used by the Customer at the time of online purchase. It should be noted that if there is no correspondence between the recipient of the Products indicated in the order form and the person who made the payment of the sums due for their purchase, the reimbursement of the sums, in case of exercise of the right of withdrawal, will be performed by Azienda Agricola Cancila, in any case, against the person who made the payment.

6.4 Azienda Agricola Cancila may withhold the reimbursement until it has received the product or until the Customer has provided proof of having returned it to Azienda Agricola Cancila, whichever occurs first.

6.5 The Customer will be responsible to Azienda Agricola Cancila for the decrease in the value of the Products resulting from their handling other than that necessary to evaluate their characteristics.

PRODUCTS
7.1 The characteristics of each Product are shown on the Site within each product sheet, however the colors of the same may not correspond to the real ones due to the internet browser and monitor used.

7.2 The Products are guaranteed against any lack of conformity existing at the time of delivery, as provided for in articles 130 and 132 of the Consumer Code. In the event that the Customer deems that the Products purchased are defective, he can return them by following the following return procedure:
a) by sending a certified email or registered letter to the Cancila Farm indicating the description of the product / s, the order number, the name of the purchaser and the defect / defect found in the product itself;
b) by sending the product / s at his own expense and care to Azienda Agricola Cancila, Via Contrada Fiumara snc 90013 – Castelbuono (PA).

7.3 Azienda Agricola Cancila will carefully examine the returned Product (which must have the various labels): in the presence of a lack of conformity, the Customer has the right, at his choice, to the replacement of the defective goods by the seller or to a refund of the price paid. in any case without charge of expenses. If the replacement is impossible or excessively expensive for the Seller, the Customer will be entitled to a refund of the price paid.

APPLICABLE LAW AND DISPUTE RESOLUTION
9.1 The General Conditions of Sale are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206 (Consumer Code) with specific reference to the legislation on distance contracts, as amended by Legislative Decree 21 February 2014 n. 21 and by the legislative decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.

9.2 For any dispute relating to the validity, interpretation or execution of these General Conditions of sale, the territorial jurisdiction is of the judge of the place of residence or domicile of the Customer.

9.3 Pursuant to art. 14 of Regulation 524/2013, the Customer is also informed that in the event of a dispute, he or she may submit a complaint via the ODR platform of the European Union which can be reached at the following link http://ec.europa.eu/consumers/odr.
